1. Acceptance of Terms
By registering, accessing, or using the Magnus Real Estate platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
2. User Accounts
To use certain features of our platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities under your account
3. User Types and Responsibilities
Buyers
- May browse, search, and book properties listed on the platform
- Agree to make payments as per booking terms
- Must conduct due diligence before making property decisions
Sellers
- Must provide accurate property information and images
- Must have legal right to list and sell/rent the property
- Responsible for honoring all bookings and transactions
- Must pay applicable fees and commissions
Agents
- Must pay commission fees to access seller and buyer contact information
- Agree to conduct business ethically and professionally
- May not misrepresent properties or mislead clients
- Commission payments are non-refundable
4. Listings and Property Information
- Sellers are solely responsible for the accuracy of property listings
- Magnus Real Estate does not verify property ownership or condition
- Users should independently verify all property information
- We reserve the right to remove any listing that violates our policies
5. Payments and Fees
- All payments are processed through our secure payment gateway
- Booking payments are non-refundable unless otherwise stated
- Agent commission fees are required to access contact information
- Platform may charge transaction fees on property sales/rentals
- All fees are listed in Tanzanian Shillings (TZS)
6. Bookings
- Bookings are subject to seller approval and availability
- Booking fees are paid to secure viewing or rental periods
- Cancellation policies vary by listing
- Disputes should be resolved directly between buyer and seller
7. Prohibited Activities
Users may not:
- Post false, misleading, or fraudulent listings
- Use the platform for illegal purposes
- Harass, threaten, or abuse other users
- Attempt to bypass payment systems
- Scrape or copy platform content without permission
- Create multiple accounts to abuse system features
8. Intellectual Property
All platform content, including design, logos, and software, is owned by Magnus Real Estate. Users retain ownership of their uploaded content but grant us license to display it on the platform.
9. Limitation of Liability
Magnus Real Estate is a platform connecting buyers, sellers, and agents. We are not responsible for:
- Property condition, legality, or accuracy of listings
- Disputes between users
- Financial losses from property transactions
- Technical issues or platform downtime
10. Dispute Resolution
Any disputes arising from use of the platform will be resolved through mediation or arbitration in Tanzania before pursuing legal action.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of new Terms.
12. Termination
We may suspend or terminate accounts that violate these Terms. Users may close their accounts at any time by contacting support.
